TERMS OF SERVICE

1. Acceptance of Terms

By accessing or using Specter ("the Service") at specter.email, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including anonymous visitors, registered users, and paid subscribers.

2. Description of Service

Specter provides disposable, temporary email address generation and inbox management. The Service allows users to create email addresses to receive messages without using their personal email. Features vary by plan:

• Free (Anonymous): Temporary mailboxes with 48-hour expiry, no account required.
• Free (Registered): 1 permanent mailbox, standard domain.
• Pro ($4/mo): Up to 10 permanent mailboxes, custom aliases, premium domains, email forwarding, outbound email (50/day).
• Enterprise ($29/mo): Up to 100 permanent mailboxes, 500 outbound emails/day, full REST API access.

3. Acceptable Use

You agree to use the Service only for lawful purposes. You must not use Specter to:

• Receive, store, or distribute illegal content
• Send or facilitate spam, phishing, or unsolicited bulk email
• Register for services in violation of those services' terms
• Conduct fraudulent activities or impersonate other individuals
• Distribute malware, viruses, or other harmful code
• Abuse the Service through automated requests at excessive rates
• Circumvent, disable, or interfere with security features of the Service
• Harass, threaten, or harm other users or third parties

We reserve the right to suspend or terminate accounts that violate these restrictions without prior notice.

4. Accounts & Registration

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized access to your account. You are responsible for all activity that occurs under your account.

You must provide accurate information when creating an account. We reserve the right to suspend accounts with false or misleading information.

5. Subscriptions & Billing

Paid plans are available on a monthly or annual basis and are paid in cryptocurrency via NOWPayments. By subscribing, you agree to submit payment in the selected cryptocurrency at the applicable rate at time of payment.

• Subscriptions renew automatically unless cancelled before the renewal date.
• Price changes will be communicated at least 14 days in advance.
• Downgrading or cancelling a subscription takes effect at the end of the current billing period.
• You retain access to paid features until the end of the paid period.

6. Intellectual Property

The Specter service, including its design, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.

You retain ownership of any content (emails, notes) stored in your account. You grant us a limited license to store and display this content solely to provide the Service.

7. Availability & Uptime

We strive for high availability but do not guarantee uninterrupted access to the Service. Scheduled maintenance, infrastructure outages, or events beyond our control may cause temporary unavailability. We are not liable for losses resulting from service interruptions.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or that emails will always be delivered.

9. Limitation of Liability

To the maximum extent permitted by law, Specter shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may close your account at any time. We may suspend or terminate your account if you breach these Terms, without liability to you. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the use of the Service shall be resolved through good-faith negotiation. If unresolved, disputes shall be subject to binding arbitration.

12. Changes to Terms

We may update these Terms at any time. Significant changes will be communicated via email or in-app notice at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance.
